A written proposal first
Magicalix works with businesses and individuals. Before work starts, a written proposal sets out the scope, deliverables, price, schedule and applicable project terms. Browsing this website or sending an enquiry does not create a project contract. Any agreed project-specific changes are recorded in writing.
Payment and acceptance
For paid creation plans, 20% of the creation fee is paid at the start and the remaining 80% at delivery, after written acceptance and before launch. Annual hosting is billed separately at launch. Larger projects may use agreed milestones. The proposal states the currency (PHP, USD or EUR), applicable taxes and payment instructions.
Domain and external costs
The client may supply a domain or ask Magicalix to register, manage and renew it at a separately quoted price. The domain remains the client’s; taking its management back incurs no Magicalix transfer fee. Domain purchase is paid when ordered and is non-refundable. Other licences, subscriptions and third-party expenses are itemised and agreed before being incurred; their cancellation or refund terms must be stated in the proposal.
Presentation, acceptance and launch
Magicalix presents the agreed deliverable for review before launch. Acceptance requires the client’s written confirmation using the method set out in the proposal; silence is not acceptance. The proposal specifies the review period and handling of requested corrections or refusal. Launch requires acceptance, payment of the applicable balance and separate launch authorisation. Delays in content, access or approval may pause the schedule.
Refund before acceptance
If the client rejects the presented deliverable before acceptance and confirms abandonment of the project, Magicalix refunds the 20% creation deposit for a paid plan and waives the remaining 80% creation fee. Hosting payments are non-refundable. Use of the abandoned deliverable must stop. This commercial refund ends at acceptance; domain purchases are also excluded. Other external costs and the refund method and timing are agreed in the proposal. Separate correction commitments and mandatory rights and remedies are not limited.
Intellectual property and use
Unless a written agreement provides otherwise, Magicalix retains copyright and other intellectual property rights it holds in its original work, reusable components and tools. After full payment, the client receives the right to use the agreed deliverables for the purposes of the project. The proposal sets out that licence and any agreed transfer of rights. Client content, brands and pre-existing materials remain with their respective rights holders; third-party components remain subject to their own licences.
Site files and intellectual property
A site-file handover can be ordered for USD 99. Before ordering, a written agreement specifies the files, editable sources, documentation and licence needed for the agreed use, including any maintenance by another provider. Migration, a backend or database export and non-transferable third-party licences are not implicitly included. Handover alone does not transfer copyright. Client-owned content remains with its rights holders; Magicalix’s original work and reusable tools follow the agreed licence or an expressly agreed transfer.
Corrections
The website includes a one-month corrective warranty (30 calendar days from final delivery). During this period, Magicalix corrects reported bugs in its work against the agreed scope at no additional charge. The final delivery date is recorded in writing. New features or scope changes are agreed separately. This additional commercial correction period does not limit any longer mandatory warranties or legal remedies.
Hosting and management
One Page and Five Pages hosting is USD 39/month, billed USD 468 annually. Growth Website hosting is USD 59/month, billed USD 708 annually. Each annual term starts at launch. Hosting payments are non-refundable. Up to two hours per month of technical support cover bugs and malfunctions, such as site unavailability or a contact form that stops sending emails. Static Website is included with hosting and covers up to three small requests per month to update existing text, images or documents. Additional management is billed monthly, separately from hosting and without a long-term commitment: Living Website USD 99, Website Growth USD 349 and Premium Package USD 999. Living Website includes content updates, one blog post per month and basic site analysis, within ten hours per month. Website Growth includes advanced site analysis and recommendations, one blog post per week, advertising management on one channel and social posting twice a month. Premium includes daily monitoring and site contributions, one blog post per week, advertising management on up to three channels and social posting as needed, with a dedicated project contact available during agreed business hours. Landing pages, ad creatives, performance tracking, workloads and implementation authority are agreed for the project. Advertising spend is separate from management fees. Renewal, expiry, response arrangements, level changes and the effective date of cancellation are agreed in writing; no one-month cancellation notice is imposed here. Extra work is not billed without agreement.
Portfolio
The project proposal provides for Magicalix to display the public-facing project, the client name and logo in its portfolio by default. Clients may opt out by telling Magicalix. This does not permit publication of confidential information, private application data or material covered by a confidentiality agreement. Visiting this website alone does not grant portfolio permission.
Project credit
A discreet Magicalix credit is included in the project footer by default. Removal can be requested for a fee stated and agreed in the proposal or a subsequent written agreement. No unspecified removal fee is imposed.
Confidentiality and AI tools
Magicalix uses AI-assisted tools to research, design, develop and review project work. Relevant project information may be processed with these service providers, subject to confidentiality commitments and applicable data-protection requirements. A non-disclosure agreement is available on request. See the privacy notice for more information.
Resolving a disagreement
The parties first seek an amicable solution, then mediation, before referring an unresolved dispute to a competent court. Philippine law and courts in Dumaguete are the intended contractual framework, where validly agreed. Mandatory consumer protections, applicable jurisdiction rules and access to urgent legal remedies are preserved.
